When you are looking at 55+ active adult communities and see the sign at the entrance that states that, have you questioned it? Has your Realtor®? Because, yes, there is a difference between “age targeted” and “age restricted”.
Similarities of Age Restricted vs. Age Targeted Communities”
The biggest similarity between age restricted and age targeted communities is that they are both marketing to the 55+ active adult demographic. The communities usually offer amenities that include lawn maintenance and possibly more.
Differences of Age Restricted vs. Age Targeted Communities
Age restricted communities must abide by The Fair Housing Act exemption and abide by the rules in the Housing for Older Persons Act (HOPA). HOPA requires that “age restricted” communities establish age verification procedures. These communities can also dictate the age restriction, it can be 55 and older, while another community may elect to be 62 and older. In accordance with HOPA, at least 80% of the community must be at or older than the age restriction.
What Buyers Should Know
Buyers should ask questions. Knowing what type of community you are moving into makes you an informed buyer. Some questions to ask:
- Is the community age restricted or age targeted?
- Are there limits on how long guests can stay?
- Are guests under age allowed to use community amenities – pool, clubhouse, etc?
- Ask for a copy of the HOA documents.
